Terms and Conditions – Chery Style
Article 1 – Definitions
1. Entrepreneur: the legal entity offering products and/or services to consumers at a distance.
2. Consumer: the natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur.
3. Distance contract: a contract concluded within the framework of a system organized by the entrepreneur for distance sales of products and/or services, whereby exclusive use is made of one or more means of distance communication.
4. Means of distance communication: any means that can be used to conclude a contract without the consumer and entrepreneur being together in the same place at the same time.
5. Cooling-off period: the period within which the consumer can exercise their right of withdrawal.
6. Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period.

Article 3 – Applicability
1. These general terms and conditions apply to every offer on the entrepreneur’s webshop and to every distance contract concluded between the entrepreneur and the consumer.
2. Before a distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.
3. If the distance contract is concluded electronically, the text of these general terms and conditions may be made available to the consumer electronically in such a way that it can be easily stored on a durable data carrier.
Article 4 – The Offer
1. If an offer is valid for a limited period or is made subject to conditions, this will be explicitly stated in the offer.
2. The offer includes a complete and accurate description of the offered products. We have done our best to display product images and colors as accurately as possible, but we cannot guarantee exact color reproduction on your screen or device.
3. Each offer contains sufficient information so that it is clear to the consumer what rights and obligations are attached to accepting the offer:
- the price including taxes;
- any delivery costs;
- how the agreement will be concluded and which steps are necessary;
- whether or not the right of withdrawal applies (sale items cannot be returned);
- the method of payment, delivery or execution of the agreement;
- the period for accepting the offer or the deadline for honoring the price;
- how the consumer can check and, if necessary, correct the data provided before concluding the agreement.
Article 5 – The Agreement
1. The agreement is concluded at the moment the consumer accepts the offer and meets the associated conditions.
2. If the consumer has accepted the offer electronically, the entrepreneur will confirm receipt of the acceptance without delay.
3. If the agreement is concluded electronically, the entrepreneur shall implement appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment.
4. The entrepreneur may assess whether the consumer can meet their payment obligations and may refuse an order with justification or set special conditions.
5. The entrepreneur shall provide the following information to the consumer:
a. contact email for complaints;
b. conditions and procedures for withdrawal or notification of exclusion;
c. the data referred to in Article 4 paragraph 3, unless already provided.
Article 6 – Right of Withdrawal for Delivery of Products
1. Consumers may cancel a purchase within 14 days without providing reasons. Returns must be registered via: https://cherystyle.com/pages/retourbeleid.
2. Creating a return label does not count as return registration. You must first register the return online to receive shipping instructions.
3. Products must be unused, undamaged, and returned in original packaging. Sale items may only be exchanged or converted to store credit. Shoe boxes may not be used as shipping containers. Return shipping costs are the responsibility of the consumer. Refunds will be issued within 14 working days of receiving the return.
4. Shipping fees: NL €5.95 under €75; BE/DE €7.95 under €75. If returns cause the total to drop below €75, shipping fees will be deducted from the refund.
5. Returns not complying with the conditions will not be processed. Customers will be notified by email.
6. The customer is responsible for correctly attaching the return label. Chery Style is not liable for misdelivery due to visible old labels.
Article 7 – Costs in Case of Withdrawal
1. The consumer bears the cost of returning the product.
2. Refunds will be made within 14 working days of receiving the returned product, provided all conditions are met.
Article 8 – Exclusion of the Right of Withdrawal
1. Sale items cannot be returned. They can only be exchanged or converted to a credit voucher if they meet all return conditions.
Article 9 – Price
1. All listed prices include VAT. Additional taxes may apply for international orders. Chery Style reserves the right to correct pricing errors and cancel affected orders.
Article 10 – Conformity and Warranty
1. Products conform to the description in the offer and meet legal requirements.
2. Defects must be reported within 24 hours of delivery. Later complaints cannot be processed.
3. No warranty is provided for decorative elements such as stones, chains, studs, etc.
4. Any defect arising during use must be reported within 24 hours and supported with photographs.
Article 11 – Delivery and Execution
1. The entrepreneur takes utmost care in processing product orders.
2. Delivery is made to the address provided by the consumer.
3. If there are delays, the consumer will be informed within one month and may cancel the contract free of charge.
4. In case of cancellation, a refund will be issued within 14 days. Shipping costs for orders outside the Netherlands are not refunded.
5. Orders marked as delivered by tracking must be reported as missing within 14 days. Late reports cannot be investigated.
6. If an order is returned due to an incorrect address or failure to collect it, the customer will be notified and can pay new shipping costs. If canceled, the items will be removed from the invoice and the original shipping fees remain payable.
Article 12 – Payment
1. Payment must be made in advance via iDEAL, PayPal, Mastercard, Visa, Bancontact, KBC, Klarna, Billink, or Riverty. If returned in accordance with return conditions, a refund will be made within 14 working days.
2. Incorrect payment data must be reported immediately.
3. In case of non-payment, the entrepreneur may charge previously communicated costs within legal limits.
Article 13 – Complaint Procedure
1. The entrepreneur has a complaint procedure in place and handles complaints accordingly.
2. Complaints must be submitted promptly, clearly, and fully described.
3. Complaints are answered within 14 days. If more time is needed, the consumer will be informed.
Article 14 – Retention of Title
1. Ownership of the delivered items passes to the consumer after full payment. Risk transfers upon delivery.
